Acceptable Use Policy

Safety

Don't use the Services - including any inputs you submit or outputs you generate - to promote, engage in, generate, contribute to, or further any illegal, unlawful, or exploitative activities or content, including without limitation:

• Sexualization, exploitation, or harm to children or minors, including the solicitation, creation, acquisition, or dissemination of child exploitative content such as child sexual abuse material, grooming communications, or sextortion content.
• The illegal distribution of information or materials to minors, including obscene materials.
• Depicting the likeness of an individual in a sexual or pornographic manner without their consent (non-consensual intimate imagery).
• Depicting or promoting human trafficking, sexual exploitation, or sexual violence, or generating pornographic or sexually explicit content.
• Promoting or facilitating self-harm, including self-injury, suicide, or disordered eating.
• Terrorism, violent extremism, or content that recruits for, incites, or provides operational support to terrorist organizations.

Likeness and Consent

Pamba is built around AI avatars and AI-generated video. Because of that, we hold likeness rights to a high standard:

• Don't create an avatar from, or generate content depicting, the name, image, voice, or other likeness of a real person without their consent.
• Don't use avatars or generated content to impersonate any real person or organization in a deceptive or harmful manner, or to falsely imply that a real person endorses a product, service, or viewpoint.
• Don't remove, obscure, or work around any AI-content labels or disclosures that Pamba or a distribution platform applies to generated content.

Civility

Don't use the Services to engage in, promote, incite, or facilitate any uncivil activity, or to generate any uncivil content, including without limitation:

• Threats, harassment, bullying, abuse, or inciting violence against any individual, group of individuals, or institution.
• Discrimination, slurs, or hate speech, or other content that dehumanizes or advocates for the discrimination of individuals or groups based on a legally protected characteristic.
• Gratuitously violent content, extreme gore, or content depicting torture, mutilation, or animal abuse.
• Profanity or vulgar content directed at an individual in order to harass or demean them.
• Disinformation, meaning content that is intentionally deceptive and likely to adversely affect public health, public safety, election integrity, or civic participation.

Integrity

Don't use the Services to engage in, promote, incite, or facilitate any fraudulent, deceptive, defamatory, scamming, spamming, or otherwise dishonest or illegal activity, including without limitation:

• Cheating, scams, or other schemes designed to defraud or deceive others.
• Fraud, defamation, or other deceptive practices intended to cause harm or obtain an unfair advantage, or that distort a person's behavior or decision-making in a manner likely to cause harm or prevent them from making informed decisions.
• Identity theft or non-consensual impersonation, including deepfakes - using another person's name, image, voice, or other likeness without their consent to impersonate them in any commercial, defamatory, illegal, or otherwise deceptive or harmful manner.
• Deceptive advertising, including fake reviews, fabricated testimonials, or undisclosed promotional content where disclosure is required by law or by the policies of the platform where the content is published.
• Spam, including the generation or distribution of unsolicited bulk messages, communications, or content.

Dignity

Don't use the Services - including any inputs you submit or outputs you generate - in a way that:

• Violates any third party's privacy, publicity, or other legal rights.
• Violates any copyright, trademark, or other intellectual property rights.
• Discriminates against any individual or group of individuals based on a protected characteristic or otherwise in violation of any applicable laws or regulations.

Distribution Platforms

Pamba can publish and schedule content to third-party platforms such as TikTok, Instagram, and Facebook on your behalf. When you distribute content through the Services:

• You must comply with the terms of service, community guidelines, and advertising policies of every platform your content is published to.
• You may only connect social media accounts that you own or are authorized to operate.
• You are responsible for any legally required disclosures on published content, including AI-generated content labels and paid-partnership or advertising disclosures.

Compliance

Don't use the Services in any way or for any purpose:

• That breaches this AUP or any third-party terms related to the use of third-party products and services, including the AI model providers and social platforms that power or receive your content.
• That violates any applicable laws or regulations.

Criminality

Don't use the Services to engage in, facilitate, or further any criminal activity, or to generate content that does so, such as:

• Promoting or facilitating the sale of illegal goods or services (such as illegal drugs or weapons), or promoting regulated goods, services, or activities in violation of applicable law or the policies of the platform where the content is published.
• Any other criminal activity.

Security

Don't use the Services to improperly collect, process, disclose, or otherwise compromise any personal, sensitive, or confidential information, or to engage in any activity that threatens the security or integrity of the Services, including:

• Collecting, processing, or disclosing - without lawful authorization or the individual's consent - personal or sensitive information such as personally identifiable information (PII), protected health information (PHI), sensitive personal information (such as racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or trade union membership), financial information (such as credit card numbers, bank account details, or other payment credentials), an individual's image, voice, or likeness, or biometric data (such as facial recognition data, fingerprints, voiceprints, or retinal scans).
• Engaging in or facilitating unauthorized access to any system, network, or data, or other malicious or disruptive activity targeting any system, network, or infrastructure.
• Creating, generating, or facilitating the creation of malicious code, malware, or computer viruses, or doing anything that could disable, overburden, interfere with, or impair the proper working, integrity, operation, or appearance of our website, the Services, or any third-party services included in the Services.
• Attempting to reverse-engineer, decompile, extract model weights, or otherwise derive the underlying algorithms, source code, or architecture of any AI models accessible through the Services, or circumventing any safety guardrails, content filters, or other protective measures implemented by Pamba or its third-party model providers.
• Extracting metadata or probing model behavior in order to infer another person's personal information or identity.

Other Restrictions

You will not use the Services if:

• You are under 18 years of age;
• You are located in any country, territory, or region that is the target of comprehensive sanctions administered by (i) the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), the U.S. Department of State, or any other U.S. government authority; (ii) the European Union or any EU Member State; (iii) His Majesty's Treasury or any other authority of the United Kingdom; or (iv) any other governmental authority with jurisdiction over Pamba or its affiliates; or
• You are, or are owned or controlled by, a person identified on any applicable sanctions-related list of designated persons, including OFAC's Specially Designated Nationals and Blocked Persons List; or
• We have previously terminated your account and informed you that you are banned from using the Services.

Managing Workspaces

If you administer or manage a workspace, you are responsible for ensuring that the members of your workspace comply with this AUP. In addition, you agree that it is a violation of this AUP if you:

• Fail to promptly report to Pamba any child sexual abuse material you become aware of in your workspace, in addition to any reporting required by applicable law.
• Fail to employ, with respect to the members of your workspace, any legally required age-gating and verification.
• Fail to cooperate with Pamba's efforts to enforce this AUP.

Enforcement

Any breach of this AUP or misuse of the Services may result in removal of content, cancellation of scheduled or pending posts, or suspension or termination of your account. In the event of termination, Pamba may also block access to a particular IP address or domain. Pamba may report any violations of applicable law or regulations to the relevant authorities and cooperate with such authorities or any third parties in any investigation, which may include disclosing your content on the Services, information related to the breach or misuse, and any other information Pamba has about you and your account.
